Public Hearing - Zoning By-law Amendment (Commercial Kennels)

Continued from Planning Board Meeting of August 22, 2023.

The Planning Board will consider a request by Maynard Crossings JV, LLC to recommend approval and potentially sponsor, proposed amendments to the Maynard Protective Zoning By-laws to allow Commercial Kennels in the Neighborhood Business Overlay District (NBOD) by Special Permit. The NBOD encompasses the Maynard Crossing Mixed-Use project at 129 Parker Street. The potential amendments are anticipated for the October 10, 2023, Special Town Meeting.  

At the August 22nd, 2023 meeting, the Board approved placement of the proposed amendment on the October 10, 2023 Special Town Meeting warrant. However, the Board did not make a recommendation for the Town Meeting as there was a change to the request restricting kennel activity to indoors-only requested.. At this meeting, the Board will make the recommendation. The revised Draft Article 9.3 is attached.

 a. Amend Section 9.3.7, Use Regulations Permitted by Special Permit of the Planning Board within the Neighborhood Business Overlay District (“NBOD”), to add the use Kennel, Commercial, provided all services offered are contained indoors and that no activities associated with the operation occur on the exterior of the business location to the list of uses allowed by Special Permit of the Planning Board within the Neighborhood Business Overlay District so as to allow such use in the NBOD located at Maynard Crossing (129 Parker Street) the Concept Plan for which was approved by Special Town Meeting on October 5, 2016.

b. Amend Section 9.3.8, Dimensional Requirements, “Table G NBOD Dimensional Requirements” to add “Kennel, commercial” to the list of Principal Uses with a “Maximum Gross Floor Area of 7,500 square feet" so as to provide for such use in the NBOD located at Maynard Crossing (129 Parker Street) the Concept Plan for which was approved by Special Town Meeting on October 5, 2016.

Discussion Item - Accessory Dwelling Units

The Board will discuss Accessory Dwelling Units and the possibility of a future amendment to the Zoning By-laws updating the current regulations governing them.

Planning Update

Planning Board meetings will be conducted with decorum.   • Please limit your comments to the topic at hand and within the purview of the Planning Board or the Maynard Protective Zoning By-Laws. 

Please note that the Planning Board will take public comments during each public hearing. The Chair will determine if public comments will be allowed on other agenda items.
